Administration - Taxicabs

SECTION 1. That Chapter 37 of the Gurnee Municipal Code, entitled "Taxicabs", is hereby amended by revoking and deleting the existing Chapter 37 in its entirety and substituting the following in its place:

"Chapter 37
Public Passenger Vehicles

37.01 DEFINITIONS

Definitions of terms as used in this Chapter:

A. License Year - May 1 through April 30 of each year.

B. Livery's Operator's License - A license issued to the owner of a livery service that is eligible to operate livery vehicles or limousines in the Village.

C. Livery Vehicle - Any public or passenger vehicle transporting passengers for hire on a prearranged contract, trip, or hourly basis; also referred to as a limousine.

D. Livery Vehicle License - A license issued for a public passenger vehicle which allows the vehicle to be operated as a limousine within the Village.

E. Owner - Any person having the use or control of one or more taxicabs or livery vehicles as herein defined.

F. Public Passenger Vehicle - Taxicabs, livery vehicles and public transportation vehicles used for transportation of passengers for hire.

G. Public Passenger Vehicle License - A taxicab vehicle license, livery vehicle license or public transportation vehicle license which has been issued pursuant to the provisions of this Chapter.

H. Public Transportation Vehicle - Any privately owned first or second division motor vehicle which is intended to be used for and is maintained or operated for the non-emergency transportation of persons for compensation and any vehicle registered as a public transportation vehicle by the Secretary of State. Excludes vehicles regulated by the Illinois Commerce Commission.

I. Public Transportation Operator's License - A license issued to the owner of a public transportation service that is eligible to operate public transportation vehicles in the Village.

J. Public Transportation Vehicle License - A license issued for a public passenger vehicle which allows the vehicle to be operated as a public transportation vehicle within the Village.

K. Taxicab - Any public passenger vehicle equipped with a taximeter and used for the carriage of passengers for hire to or from destinations as directed by such passenger(s) and any vehicle registered as taxicab by the Secretary of State.

L. Taxicab Operator's License - A license issued to the owner of a taxicab service that is eligible to operate taxicabs in the Village.

M. Taxicab Vehicle License - A license issued for public passenger vehicle which allows the vehicle to be operated as a taxicab within the Village.

N. Taximeter - Any mechanical or electrical device attached to a taxicab which records and indicates a charge or fare in dollars and cents measured by distance traveled or waiting time or both.

O. Village - The Village of Gurnee.

37.02 DUTIES OF TAXICABS, LIMOUSINES AND PUBLIC TRANSPORTATION VEHICLES

Every public passenger vehicle is required to furnish clean, comfortable, and safe service. Taxicab fares shall comply with the provisions of Section 37.03 (f). Limousines and public transportation vehicles shall provide service at reasonable rates. All public passenger vehicles shall be operated in accordance with this Chapter and all other applicable statutes, ordinances, codes, rules and regulations.

37.03 LICENSING AND ENFORCEMENT; ESTABLISHMENT OF FEES

A. The licensing of taxicab operators, livery operators, public transportation operators and public passenger vehicles shall be under the control and supervision of the Village Clerk. The enforcement provisions of this Chapter shall be under the control and supervision of the Chief of Police, including the making of any vehicle and taximeter inspections provided for by this Chapter.

B. The Chief of Police shall have the authority to appoint such persons as he may deem necessary to enforce the provisions of the Chapter and to perform any duties assigned to the Chief of Police by this Chapter.

C. The Village Clerk shall have the authority to appoint such persons as he or she may deem necessary to perform duties that are under the control and supervision of the Village Clerk.

D. The Village Clerk shall have the authority to establish fees for any license to be issued pursuant to this Chapter. The amount of any fee established by the Village Clerk shall be equivalent to or based upon the costs incurred by the Village in enforcing the provisions of this Chapter, including, but not limited to, the costs of issuing licenses. The schedule of fees is attached hereto as Exhibit A.

37.04 LICENSE REQUIRED

A. It shall be unlawful for any person to own or operate a taxicab service within the corporate limits of the Village of Gurnee without having first obtained a taxicab operator's license from the Village. Each taxicab operator's license shall specify the maximum number of taxicabs that may be operated by the taxicab service. It shall be unlawful for any person who has been issued a taxicab operator's license to operate more taxicabs than the maximum number authorized by the license.

B. It shall be unlawful for any person to own or operate a livery service within the corporate limits of the Village of Gurnee without first having obtained a livery service operator's license from the Village.

C. It shall be unlawful for any person to own or operate a public transportation service within the corporate limits of the Village of Gurnee without first having obtained a public transportation service operator's license from the Village.

D. It shall be unlawful for any vehicle to solicit business, to accept for transportation any passengers within the Village boundaries, or to otherwise operate as a taxicab within the Village unless the vehicle has been issued a valid Village of Gurnee taxicab vehicle license. Any vehicle, which is operated in violation of this Section, shall be subject to immediate removal from service.

E. It shall be unlawful for any vehicle to solicit business, or to accept for transportation any passenger, or to otherwise operate as a livery vehicle within the Village unless the vehicle has been issued a valid Village of Gurnee livery vehicle license. Any vehicle, which is in violation of this Section, shall be subject to immediate removal from service.

F. It shall be unlawful for any vehicle to solicit business, or to accept for transportation any passenger, or to otherwise operate as a public transportation vehicle within the Village unless the vehicle has been issued a valid Village of Gurnee public transportation vehicle license. Any vehicle, which is in violation of this Section, shall be subject to immediate removal from service.

G. The provisions of this Chapter shall not prevent taxicabs, livery vehicles or public transportation vehicles licensed by other municipalities from entering the Village of Gurnee for the purpose of depositing passengers who were legally picked up outside the Village. The provisions of this Chapter shall not apply to taxicabs, livery vehicles or public transportation vehicles, which do not stop within the Village for the purpose of picking up or depositing passengers.

H. All licenses provided for under this Chapter shall be valid only for the license year for which or during which the license is issued.

37.05 LICENSES A NON-VESTED NON-EXCLUSIVE PRIVILEGE

A. The Village of Gurnee has, as of the adoption of the provisions of this Chapter, set no limit on the number of taxicabs, limousines or public transportation vehicles which may be operated within the Village. The Village of Gurnee may from time to time determine that public convenience and necessity require a limitation on the number of taxicabs, limousines and public transportation vehicles in service and licenses issued.

B. Nothing in this Chapter shall be construed as the granting of a vested or exclusive right to any licensee to engage in the business of operating taxicabs, limousines or public transportation vehicles within the Village. Every license hereunder shall be regarded only as a privilege which is afforded the person or corporation to whom it is issued and which may be modified, suspended, revoked, canceled, invalidated or otherwise voided by the Village of Gurnee at any time.

37.06 TAXICAB SERVICE, PUBLIC TRANSPORTATION SERVICE AND LIVERY SERVICE

A. Every taxicab service, public transportation service and livery service which is licensed by the Village shall keep in operation at all times regular telephone service so that a person desiring to hire a public passenger vehicle may call the taxicab, public transportation service or livery service. The owner of the taxicab, public transportation service or livery service will list the telephone number in the local and regional telephone directories which are published for the Village by the telephone company which furnishes local telephone service.

B. Every taxicab service, public transportation service and livery service which is licensed by the Village shall operate public passenger vehicles regularly in the Village so as to meet the public demand for passenger service. They shall maintain a central place of business open 24 hours a day for receiving calls and dispatching vehicles.

C. Every taxicab service, public transportation and livery service which is licensed by the Village shall answer all calls received for service within the Village as soon as possible. If service cannot be rendered within a reasonable time the service will notify the customer of such and give the reason(s) for the delay. It shall be unlawful for any taxicab service, public transportation service or livery service which is licensed by the Village to refuse to accept a request for service anywhere within the Village at any time vehicles are available to provide the service.

D. It is unlawful for any taxicab service, public transportation service or livery service which is licensed by the Village to knowingly encourage or allow a vehicle to operate as a taxicab, public transportation vehicle or limousine without having first obtained the appropriate type of public passenger vehicle license. It is unlawful for any taxicab service, public transportation service or livery service which is licensed by the Village to knowingly encourage or allow a person to operate a taxicab, public transportation vehicle or livery vehicle in violation of the provisions of this Chapter.

37.07 TAXICABS

(A) Taxicab Vehicle Licenses; Inspections.

  1. Application for a taxicab vehicle license shall be made by the owner of the vehicle upon forms furnished by the Village. Such application shall identify the vehicle owner and shall contain a complete description of the vehicle including make, model, year, color, State registration number, vehicle identification number, cab company name, and company assigned vehicle number. Also required are copies of the vehicle registration card and documentation confirming that there has been compliance within the insurance requirements of Section 37.13.
  2. No taxicab vehicle license shall be issued for any vehicle that is not owned or affiliated with a taxicab service which has been licensed by the Village.
  3. No taxicab shall be licensed until it has been thoroughly and carefully examined by an Automotive Service Excellence (A.S.E.) certified technician and found to be in safe condition for passengers, of good appearance and well painted. Each applicant shall provide written documentation that the taxicab to be licensed has been inspected and found to be in a safe condition, as required by this Section.
  4. Taxicabs shall also be subject to re-inspection at any time. All taxicabs must be safety inspected semi-annually by an A.S.E. certified technician and written documentation that the vehicle has passed the safety inspection for the current license year must be presented upon request by the Chief of Police or his designee.
  5. Any time a taxicab is involved in an accident that causes damage which may affect the safety of prospective passengers, it must be taken out of service immediately and repaired by an A.S.E. certified technician.
  6. The Chief of Police may require a taxicab to be re-inspected as a result of a complaint by any person, or if the Chief of Police has reason to believe that the condition of the taxicab may pose a threat to safety of its passengers or has reason to believe that the taxicab is not in compliance with the provisions of this Chapter.
  7. Any taxicab that does not pass a safety inspection for any reason shall be immediately put out of service until the taxicab passes the safety inspection.
  8. A taxicab which fails to pass a safety inspection, fails to undergo a safety inspection when directed to do so or otherwise is in violation of any provision of this Section may be immediately removed from service.
  9. When a taxicab is permanently removed from service by the owner, the taxicab vehicle license issued to that vehicle must be immediately surrendered to the Village Clerk or his or her designee.

(B) Taxicab License Sticker and Display

  1. A taxicab vehicle license issued by the Village shall be in the form of an adhesive sticker which shall contain the sequential number starting at 0001, along with displaying the expiration date of the license.
  2. Taxicab vehicle licenses shall be of a distinctly different color and/or design every year. Taxicab vehicle licenses must be affixed to the lower right portion of the windshield of the vehicle for which the license has been issued.
  3. A taxicab vehicle sticker is not transferable to any vehicle other than the vehicle for which it has been issued.

(C) Taxicab Vehicle Identification

  1. Every taxicab licensed in the Village shall bear on both sides of the vehicle, in a color contrasting to that of the vehicle itself, the name and telephone number of the company which it serves. The lettering shall be a minimum of 2 inches in height and 1/4 - inch brush stroke.
  2. The identification number assigned to the taxicab by the company shall be affixed to the exterior of the vehicle on the left and right sides and on the rear of the vehicle. These numbers must be a minimum of 2 inches in height and 1/4 - brush stroke.

(D) Taxicab Stands

  1. The Chief of Police shall have the authority to create on public property, and with the permission from the owner, on private property, taxicab stands where cabs licensed by the Village may wait for passengers.
  2. The Chief of Police shall also have the authority to limit the number of taxicabs permitted to use a taxicab stand at any given time.
  3. Rules of conduct at taxicab stands shall include, but are not limited to, the following:
  4. Taxicabs entering a taxicab stand or line shall take the rear positions. Overcrowding cabstands or lines is prohibited.
  5. While taxicabs occupy designated taxicab stands, no other taxi shall bypass the cab line and accept passengers for services unless payment is to be made by a third party through use of a voucher.
  6. The first taxicab in line shall be eligible for the first available fare, unless a passenger indicates a preference for another taxicab in that line.
  7. No taxicab shall accept a load along side of, in front of, or adjacent to an established occupied taxicab stand.
  8. Livery vehicles and public transportation vehicles shall not park in taxicab stands.
  9. Public passenger vehicle drivers shall not sleep or lounge while posted in a cabstand.
  10. There shall not be more than two occupants in any vehicle posed at a cabstand.

(E) Taximeters

  1. No taxicab shall be issued a Village of Gurnee taxicab vehicle license until its taximeter is tested and certified to be accurate and sealed.
  2. No taxicab shall operate for hire in the Village unless the taximeter is accurately recording the fare to be charged.
  3. The taximeter shall be located so that its face can be seen by any passenger riding in the taxicab.
  4. Adequate illumination shall be provided for the face of the taximeter so that it may be read by the passenger whenever the vehicle is in operation.
  5. No person operating or owning any taxicab shall transfer any taximeter to any other vehicle unless the meter is inspected, reprogrammed and certified at a taximeter-testing center.
  6. If a taxicab has service performed on or changes made to the transmission, any drive train component, or the size of the tire, the owner of the taxicab must have the taximeter inspected, reprogrammed and certified at a taximeter-testing center.
  7. There shall be programmed into the meter of any taxicab licensed in the Village only one rate of fare. The rates shall conform to the provisions in Section 37.03 (F).
  8. It shall be unlawful to have in any taxicab more than one taximeter.
  9. It shall be unlawful to attempt to remove, tamper with, or alter a taximeter seal.
  10. Any person convicted of tampering with or otherwise manipulating a taximeter and any person found to have tampered with a taximeter seal or found with a fraudulently obtained taximeter seal will be subject to a $250 fine for the first offense. A $500 fine will be assessed for the second offense. In addition, the public passenger vehicle driver/operator registration of such person will be revoked for a second offense.
  11. It shall be unlawful for any holder of a taxicab operator's license to knowingly allow or encourage a driver working for that company to operate a taxicab that is in violation of any provision of this Section.
  12. The Chief of Police shall have the authority to require that a taximeter be re-certified and resealed at any time the Chief has reason to believe that the taximeter may not be accurate or that there may have been tampering with or an unauthorized adjustment made to the taximeter.
  13. Any taxicab which has a taximeter found to be in violation of any provisions of this Section may be immediately removed from service.

(F) Rates of Fare - Taxicabs

All taxicab rates of fare must be submitted on the application for license to operate within the Village of Gurnee. Said rates must also be prominently displayed in the taxicab so they may be seen by all passengers. Any changes in rates must be submitted to the Village Clerk 10 days prior to the effective date thereof.

37.08 LIVERY VEHICLES

(A) Livery Vehicle Licenses; Inspection

  1. Application for livery vehicle license shall be made by the owner of the vehicle upon forms furnished by the Village. Such application shall identify the vehicle owner, and contain a complete description of the vehicle including make, model, year, color, State registration number, vehicle identification number, livery company name, and company assigned vehicle number (if applicable). Also required are copies of vehicle registration card and document confirming that there has been compliance within the insurance requirements of Section 37.13.
  2. No livery vehicle license shall be issued for any vehicle which is not owned or affiliated with a livery service which has been licensed by the Village.
  3. No livery service shall be licensed until it has been thoroughly and carefully examined by an Automotive Service Excellence (A.S.E.) certified technician and found to be in safe condition for passengers, of good appearance and well painted. Each applicant shall provide written documentation that the livery vehicle to be licensed has been inspected and found to be in a safe condition, as required by this Section.
  4. Livery vehicle shall be subject to re-inspection at any time. All livery vehicles must be safety inspected semi-annually by an A.S.E. certified technician and written documentation that the vehicle has passed the safety inspection for the current license year, must be presented upon request by the Chief of Police or his designee.
  5. Any time a livery vehicle is involved in an accident that causes damage which may affect the safety of prospective passengers, it must be taken out of service immediately and repaired by an A.S.E. certified technician.
  6. The Chief of Police or his designee shall have the authority to immediately remove from service any livery vehicle that has been designated unfit for service or unsafe.
  7. The Chief of Police may require a livery vehicle to be re-inspected as a result of a complaint by any person, or if the Chief of Police has reason to believe that the condition of the livery vehicle may pose a threat to the safety of its passengers or has reason to believe that the livery vehicle is not in compliance with the provisions of this Chapter.
  8. Any livery vehicle that does not pass a safety inspection for any reason shall be immediately put out of service until the livery vehicle passes the safety inspection.
  9. A livery vehicle which fails to pass a safety inspection, fails to undergo a safety inspection when directed to do so or otherwise is in violation of any provision of this Section may be immediately removed from service.
  10. When a livery vehicle is permanently removed from service by the owner, the livery vehicle license issued to that vehicle must be immediately surrendered to the Village Clerk or his or her designee.

(B) Livery Vehicle License Sticker and Display

37.09 PUBLIC TRANSPORTATION VEHICLES

(A) Public Transportation Vehicle Licenses; Inspections

  1. Application for a public transportation vehicle license shall be made by the owner of the vehicle upon forms furnished by the Village. Such application shall identify the vehicle owner, and contain a complete description of the vehicle including make, model, year, color, State registration number, vehicle identification number, public transportation company came and company assigned vehicle number (if applicable). Also required are copies of the vehicle registration card and documentation confirming compliance with the insurance requirements of Section 37.13.
  2. No public transportation vehicle license shall be issued for any vehicle that is not owned or affiliated with a public transportation service which has been licensed by the Village.
  3. No public transportation vehicle shall be licensed until it has been thoroughly and carefully examined by an Automotive Service Excellence (A.S.E.) certified technician and found to be in safe condition for passengers, of good appearance and well painted. Each applicant shall provide written documentation that the public transportation vehicle to be licensed has been inspected and found to be in a safe condition, as required in this Section.
  4. Public transportation vehicles shall also be subject to re-inspection at any time. All public transportation vehicles must be safety inspected semi-annually by an A.S.E. certified technician and written documentation that the vehicle has passed the safety inspection for the current license year must be presented upon request of the Chief of Police or his designee.

The Chief of Police may require a public transportation vehicle to be re-inspected as a result of a complaint by any person, or if the Chief of Police has reason to believe that the condition of the public transportation vehicle may pose a threat to the safety of its passengers or has reason to believe that the public transportation vehicle is not in compliance with the provisions of this Chapter.
  8. Any public transportation vehicle that does not pass a safety inspection for any reason shall be immediately put out of service until the public transportation vehicle passes the safety inspection.
  9. A public transportation vehicle which fails to pass a safety inspection, fails to undergo a safety inspection when directed to do so or otherwise is in violation of any provision of this Section may be immediately removed from service.
  10. When a public transportation vehicle is permanently removed from service by the owner, the public transportation vehicle license issued to that vehicle must be immediately surrendered to the Village Clerk or his or her designee.

(B) Public Transportation License Sticker and Display

  3. A public transportation vehicle sticker is not transferable to any vehicle other than the vehicle for which it has been issued.

(C) Public Transportation Vehicle Identification

  1. Every public transportation vehicle in the Village shall bear on both sides of the vehicle, in a color contrasting to that of the vehicle itself, the name and telephone number of the company it serves. The lettering shall be a minimum of 2 inches in height and 1/4 inch brush stroke.
  2. The identification number assigned to the public transportation vehicle by the company (if applicable), shall be affixed to the exterior of the vehicle on the left and right sides and on the rear of the vehicle. These numbers must be a minimum of 2 inches in height and 1/4 inch brush stroke.

37.10 DRIVERS AND OPERATORS

A. It shall be unlawful for any person to operate a public passenger vehicle in the Village without first having registered with the Village as a driver/operator.

B. It shall be unlawful for any person owning or controlling any public passenger vehicle to employ or permit any person to operate such vehicle for hire within the Village unless the driver has registered with the Village.

C. Any person desiring to register as a public passenger vehicle driver/operator must file a written application with the Village Clerk.

D. The contents of the application shall be determined by the Village Clerk.

E. Applicants must meet the following qualifications:

  1. Be no less than 21 years of age;
  2. Must not be afflicted with any infirmity of body or mind which may render him or her unfit for safe operation of a public passenger vehicle;
  3. Must have a valid Illinois driver's license;
  4. Must not have been convicted of a Class A misdemeanor or felony charge within the last five (5) years, or show a previous background that indicates a tendency to act in a manner that may place the public at risk.
  5. Must not have had his or her license suspended or revoked in any state within the last three (3) years for any violation of law concerning the operation of a motor vehicle; and
  6. Must be able to read, write, and speak the English language at a level of expertise sufficient to effectively function as a public passenger vehicle operator.

F. The registration applicant shall supply two photographs of the applicant, approximately 2 inches by 2 inches. The photographs must be recent, taken no more than 60 days prior to the date of application, showing the head and shoulders of the applicant in a clear and distinguishable manner.

G. When the application is filed and its processing fee paid, the Chief of Police will conduct a thorough application background check. The Chief of Police may also conduct an examination of the applicant to determine if the applicant is familiar with traffic laws and ordinances and is otherwise competent to operate a public passenger vehicle. The content of any examination administered will be determined by the Chief of Police.

H. Every person registered as a public passenger vehicle driver/operator will be issued a photo identification tag. The photo identification tag shall be prominently displayed in the public passenger vehicle at all times.

I. Any public passenger vehicle found being operated by a driver who has not registered with the Village shall be immediately removed from service.

J. Any person registered as a driver/operator must inform the Village Administrator within ten (10) days of any change of address or telephone number.

K. A person requesting to renew registration as a driver/operator shall submit an application to the Village clerk prior to the date the current registration is scheduled to expire. No registration shall be renewed until after the Chief of Police has conducted a review of the renewal applicant's driving record and criminal background. No driver/operator registration will be renewed unless the Chief of Police and the Village Clerk determine that the applicant for renewal continues to meet the requirements for operating a public passenger vehicle in the Village.

37.11 PUBLIC PASSENGER VEHICLE OPERATIONS

A. No operator of a public passenger vehicle shall carry more than the rated passenger load per vehicle.

B. After a public passenger vehicle has been hired by one or more persons traveling together, the operator shall not pick up other passengers.

C. It is the duty of the driver of any public passenger vehicle licensed in the Village to accept as a passenger any person who seeks service provided that the person conducts himself or herself in an orderly manner.

D. The driver of a public passenger vehicle shall transport his or her passenger to the point of destination by the most direct route available.

E. No person shall operate a public passenger vehicle within the Village who is under the influence of an intoxicating beverage or a controlled substance or who at any time within ninety (90) minutes prior to operating such vehicle has consumed an alcoholic beverage or a controlled substance.

F. It shall be unlawful for any operator of a public passenger vehicle to use obscene or profane language in the presence of any passenger.

G. It shall be unlawful for any public passenger vehicle licensed by the Village to advertise for the purpose of business or commercial uses unrelated to the public passenger vehicle company.

H. It shall be unlawful for any public passenger vehicle which transports passengers to convey toxic, hazardous or biological waste at any time.

I. It shall be unlawful for any public passenger vehicle operator or company to use a radio frequency scanner or scanning type radio to monitor the radio frequency of a competing company for the purpose of stealing the fares of the scanned company.

J. It shall be unlawful for any public passenger driver or company representative to offer compensation to the employees of any business in Gurnee in order to direct prospective customers to that driver or company. It shall be unlawful for any person to accept or solicit compensation from a public passenger driver or company representative in return for directing prospective customers to that driver or company.

K. The operator of a public passenger vehicle shall be courteous to passengers, prospective passengers and other drivers at all times.

L. If any public passenger vehicle driver violates the provisions of this Section, the vehicle he or she is operating may be immediately removed from service.

M. It is unlawful to transfer any public passenger license from one vehicle to another.

M. The driver of any public passenger vehicle, while posted at any location in Gurnee awaiting a fare, shall remain in or in close proximity to the vehicle he is operating. He or she may leave his or her vehicle unattended for a period of no longer than ten (10) minutes.

N. No public passenger vehicle driver/operator shall be on duty as a driver or operator for more than 16 of any 24 consecutive hours and no licensed owner shall permit any registered driver/operator to be on duty for more than 16 of every 24 consecutive hours.

O. Every public passenger vehicle driver/operator shall obey all traffic rules and regulations established by Illinois Compiled Statutes or Village ordinances while driving or operating a public passenger vehicle within the Village.

37.12 FIXING OF RATES

It shall be unlawful for any person, firm or corporation licensed under the provisions of this Chapter to conspire among themselves or with other persons to fix or control rates for public passenger vehicles within the Village. It is the purpose of the Chapter to provide for free and uncontrolled rates.

Any scheme, device or other subterfuge employed by any person to evade this purpose shall be deemed to be in violation of this Chapter and grounds for revocation of the license.

37.13 INSURANCE

A. No person will be registered as a Village public passenger vehicle/operator and no taxicab vehicle license, livery vehicle license or public transportation vehicle license shall be issued until all the requirements of the state laws concerning insurance issued to compensate any person who may suffer damage as a result of operation of this vehicle have been met.

B. All applicants for licenses provided for by this Chapter shall, as part of their application, submit proof of insurance in the amounts required by current state law.

C. There shall be affixed on a conspicuous part of each public passenger vehicle a sticker which indicates that the vehicle has complied with the requirements of the Illinois Vehicle Code (625 ILCS 5/8-101 through 8-116).

37.14 IMMEDIATE REMOVAL FROM SERVICE

A. Where the Chapter provides that a public passenger vehicle shall be immediately removed from service, the vehicle may be removed from service by towing. If a vehicle is removed by a tow agency for infarctions of this Ordinance, any and all towing fees will be the responsibility of the license holder.

B. If a vehicle is removed from service, the owner or operator is wholly responsible for any towing and impound charges that occur, unless the Chief of Police determines that there was no basis for removing the vehicle from service.

C. Any public passenger vehicle which is operated in violation or contains a condition which violated a provision of this Chapter shall be immediately removed from service.

37.15 PENALTY

A. Any person violating any provision of this Chapter shall be fined not less than $25.00 nor more than $500.00 for each offense. A separate offense shall be deemed committed for each day during or on which a violation occurs or continues.

B. Upon the third or subsequent offense, the Chief of Police may recommend to the Mayor that a Taxicab Operator's License, Livery Service Operator's License or a Public Transportation Service Operator's License be suspended or revoked.

37.16 VILLAGE TO KEEP RECORDS

The Village Clerk shall keep records of any pertinent information concerning public passenger vehicles and drivers or operators. These records shall be available for inspection by the public in accordance with the provisions of the Illinois Freedom of Information Act (5 ILCS 140/1 et seq.)"
