4. Final Plat: Seday's Resubdivision
This suWivision consists of two lots
on 0.74 acres at the northwest corner of Delany Road and Jeffrey
Avenue, under the R-3 zoning district. Water and sanitary sewer
presently front the property. Relief is requested for curb, gutter,
and sidewalk.
Lot 1 will be 18,900 square feet and
Lot 2 will be 13,500 square feet, both of which will meet all
setbacks.
Engineering finds this Final Plat to
be in general conformance with the Subdivision Ordinance and recommends
its approval subject to consideration of relief requested and
final engineering.
Mr. Gill rnoved, seconded by Mr. Robison,
to forward a favorable recommendation to the Village Board on
the Final Plat of the Seday Resubdivision with relief requested,

5. Public Hearing: Petition of Louis
and Mary Vasquez for a Special Use Permit to allow the establishment
and operation of a travel agency office at 100 South Greenleaf
Street.
Mr. David Ladehoff and Mr. Seth Pines,
architects with Ladehoff and Pines; and Kris Nelson, Vasquez Management,
were in attendance to present information on this petition.
It was explained that this parcel is currently zoning C/0-1 and the petitioner will be constructing a building to house the Vasquez Management Company. Under the C/0-1 zoning district, a special use permit is required for a travel agency. However, the travel agency (MlLA-Travel Bureau) is not for
public use, and will occupy 10% of
the building. The agency belongs to a nationwide program working
with museums, universities, corporation, etc., to set up conventions,
conferences and tours. One person runs the agency, dealing with
95% of the business by phone.
There is not a specific landscaping
plan at this time to address the site. There are a line of trees
to the west along with a 20-foot wide buffer between the parking
lot and the west property line.
Utilities will be run from Greenleaf
and detention will either be provided on site or money will be
placed in lieu of on site facilities, subject to review by the
Village Engineer.
Ms. Marilyn Lester, 75 S. First Street,
expressed concern for the wildlife in the area. She would like
to see specifically where the building is to be located to be
assured that the wooded area housing the wildlife would be preserved.
Mr. Elmer Anderson, 79 S. Delany, had
the following questions: the size of the buffer zone, why a special
use permit is required, if busses will be using this facility,
and where the water will drain.
Ms. Sue Muchowski, 164 S. Delany, inquired
what can go into the space if the special use is granted, but
the occupancy leaves. She also inquired where the parking lot
will be located and if there will be bushes in front of the parking
lot. She informed the Commission that the Woodcrest Subdivision
nearby had removed some trees and asked if the Village has looked
into this. She also stated concern with the parking lot turning
into a "hang-out" for teenagers.
Mr. Dave Ballard, 4130 Oglesby, raised
the following inquires: hours of operation, number of parking
spaces, and type of parking lot lights. He was concerned with
lights directed towards residents' homes.
Mr. Bill Lebensorger, 130 S. Delany,
asked the Commission if the public would have a chance to vote
on or agree with plans on buffering and lighting.
Mr. Wildenberg explained that a travel
agency is required to have a Special Use Permit under the C/O1
zoning district. If the user moves out, the special use would
be discontinued and the new user could use the space for any permitted
use under the C/0-1 district or reapply for a special use.
Mr. Ladehoff replied the following:
1 . Trash containers will be enclosed by a wood screen. 2. Access
is to be off of Oglesby not Greenleaf, per Lake County Division
of Transportation. 3. The parking lot lights will not be allowed
to spill onto other properties.
It was explained that the public hearing
process allows people to address concerns to the Plan Commission,
but that the public does not get to vote on specific site plan
elements.
Discussion was made as to the installation
of a sidewalk along the petitioner's frontage on Oglesby.
There will be 29 parking spaces provided.
The parking lot will be lit for security purposes.
Mr. Butch Maiden informed the petitioner
that the two spaces immediately to the west side of the parking
lot may be eliminated. Mr. Maiden explained that the entrance
and exit could also function as one-way. He also suggested that
the width of the exit aisle be cut-down from 18 to 12 feet.
Kris Nelson stated that the hours of
operation are currently 8 A.M - 5 P.M., but have been contemplated
to change to 7 A.M. - 7 P.M. There would be no bus traffic. Currently
there are 12 fulltime employees, but that number is expected to
grow to approximately 20.

Mr. Robison moved, seconded by Mr.
Gill, to forward a favorable recommendation to the Village Board
on the Vasquez Petition for a Special Use Permit to allow the
establishment and operation of a travel agency at 100 S. Greenleaf
Street with special consideration to: protecting adjacent property
owners from light spillage; tree replacement per Village Ordinance;
parking lot changes as noted; hours of operation to be identified;
screening of the trash container; and that the petitioners come
before the Plan Commission with the final site plan. Roll Call

6. Public Hearing: Petition of American
Process Systems for a Special Use Permit to allow the expansion
of an existing manufacturing facility at 3815 Grandville Avenue.
Mr. Steven Bent, president and owner,
and Mr. Dan Bleck, architect, were in attendance to present information
on the petition.
This operation has been in business
since 1982, when it received a special use permit for the manufacturing
of stainless steel containers. Proposed is a 15, 400 square foot
addition to the south of the existing building on the recently
acquired 1 1/3 acres.
Currently, there are two storage yards
in place on the site. The storage area on the west will remain
and be converted to parking; storage will be to the rear of the
building.
Mr. Bent explained that due to the
increased work load, a second shift had to be added. He further
explained that the noise problems are sometimes created from the
fabricating and grinding of the stainless steel containers coming
through the openings in the building closest to the residential
area. It is his intention to move this part of the operation to
the addition where there are no openings for noise to escape to
the residential area.
Storm water detention would need to
be maintained. There will be a series of parking lot ponds for
storm water run-off. There is a detention area located at the
northwest corner of the site.
The addition would be constructed out
of brick masonry and metal siding.
There are no parking lot lights at
this site. There will be a light on the building on the west side,
but not on the east.
The eastern border of the site is screened
by a 6-foot wood fence above grade.
Mr. Clyde Hermanson, 3781 Grandville,
stated he lives next door to this operation and has been working
with Jon Wildenberg for six months to resolve the noise issue.
In his opinion, American Process Systems does not care about the
neighborhood. He also stated that he has called the Gurnee Police
Department with regard to extreme noise coming from the grinding,
yelling and radios after 10:00 P.M. and before 6:00 A.M. He questioned
if the second shift would remain and if a third shift would be
added.
Ms. Gloria Gallegos, 978 Waveland,
stated concern with the state of the bushes used for screening
at their property line with American Process; trucks using Waveland
as a "cut-through;" and what guarantee there is that
the addition will reduce noise. She was also concerned that expansion
meant double noise, workers, etc.
Mr. Robert Zerba, 988 Waveland, was
worried that more workers meant more traffic and a six-foot fence
would not stop the noise. He also stated that the noise emanating
from the site is very annoying

Mr. Roy Gallegos, 978 Waveland, was
upset at the noise occurring from 5:00 A.M. to 12:30 P.M.
Mr. Bent proclaimed that he does have
a concern for the neighborhood and wants to resolve the noise
situation. He explained that the fence is to screen the storage
yard, not to screen noise.
The State is contemplating closing
Grandville at Route 41 at some future date.
Mr. Smith moved, seconded by Mr. Robison,
to forward a favorable recommendation to the Village Board on
the Special Use Permit of American Process Systems to allow the
expansion of an existing manufacturing facility at 3815 Grandville
Avenue, subject to: 1. The possibility of closing some of the
openings on the east side of the building; 2. The Village continuing
to monitor the noise situation; and 3. Development otherwise consistent
with testimony and plans presented. Roll Call Vote: Ayes: Robison,

7. Public Hearing: Petition of Frank
K. Leung M.D., S.C., for a Special Use Permit to allow establishment
and operation of a first floor medical office and a second floor
one-bedroom apartment unit at 4040 Grand Avenue.
Mr. Dan Robison, architect, was present
to inform the Commission of this petition.
The property is located on the north
side of Grand Avenue between Greenleaf and Delany, consisting
of 25, 000 square feet. The contemplated use would consist of
a waiting room, two examination rooms, office, and reception area,
all of which on the first floor. The second floor is intended
to be a one-bedroom apartment.
Parking would be provided for 12 cars,
including the garage. The entrance to the doctors office would
be at the rear of the building and the entrance to the apartments
in the front. The parking lot would be paved and the apron and
driveway would be widened.
A decorative fence will be placed along
the driveway back to the garage. Berming and shrubs would be installed
to screen the parking area. Shrubs will also be installed along
the eastern border.
The office will be open 2-3 days a
week, exact hours of operation are not yet available.
Mrs. Nancy Tippet, 786 Greenleaf, expressed
concern with the upkeep of the lot and questioned the integrity
of the doctor as a result. She asked if lights would be used in
the parking area.
Mrs. Joan Lasdasky, 776 Greenleaf,
questioned if a fence could be installed on the eastern portion
instead of shrubs to shied car lights.
Mr. Will Tippet, 786 Greenleaf, was
concerned about the renting out of the apartment and upkeep of
the property, increased traffic, and light spillage.
Mr. Ed Elk, 4067 Grand, asked what
guarantee there would be for providing the parking lot and if
parking is allowed in a front yard.
It was explained that parking is allowed
in the front yard per the zoning district.
There will be no parking lot lights,
but a light will be mounted on the building for the sidewalk.
The site is to be maintained consistent
with the surrounding property owners.

It is believed by having an apartment
on the second floor, it would act as security for the building
and ensure it's upkeep.
Discussion was made as to the elimination
of two front yard parking spaces.
Mr. Karlovics moved, seconded by Mr.
Smith, to forward a favorable recommendation to the Village Board
on the Special Use Permit of Dr. Leung, for a first floor medical
office and a second floor onebedroom apartment at 4040 Grand Avenue,
subject to: 1. The property to be maintained consistently with
the neighborhood; 2. Additional fencing, opaque in nature, to
be added to screen parking areas; 3. The elimination of two front
yard parking spaces and their relocation to the rear; and 4. Development
otherwise consistent with testimony and plans presented. Roll
Call Vote: Ayes: Hellstern, Smith, Gill & Karlovics Nays:
