Public Hearing to consider the petition of Mike Minchillo Construction LLC for a first amendment to an annexation agreement, approved as Ordinance #2006-91, dated November 6, 2006.

Mayor Kovarik called the public hearing to order at 7:17 p.m.

Mr. Muetz said this is a Public Hearing to consider the petition of Mike Minchillo Construction LLC for a first amendment to an annexation agreement, approved as Ordinance #2006-91, dated November 6, 2006.

 

Mr. Muetz stated in 2006, the petitioner received annexation, rezoning, and preliminary plat approval for a 10-lot single family subdivision known as Normandy Woods. The subject property was rezoned to the R-3, Single Family Residence District.  Due to the collapse of the housing market, Mr. Minchillo never pursued the Final Subdivision Plat, nor began construction of the subdivision.

 

Minchillo continues to own the subject property.  Rather than plat all 10 lots at once, he would like to use a phasing approach as lot/housing demand exists.  To better reflect current trends of potential buyers, he is requesting the following revisions to the development and annexation agreement: 

 

  1. Decrease the minimum square footage for a one story dwelling from 2,400 square feet to 1,800 square feet;
  2. Remove the minimum 2,200 square foot requirement on the first floor for a two story dwelling;
  3. Establish a minimum 2,400 total square feet for a two story dwelling;
  4. Allow the use of stucco material on the front elevation, in addition to the previously allowed brick and/or stone masonry materials;
  5. Allow the use of stucco material, smart siding, cedar or hardy board on non-front elevations, in addition to the previously allowed brick and/or stone masonry;
  6. Seed the front yard and Village parkway, rather than sodding; and
  7. Reduce the minimum garage requirement from a three car garage to a two car garage.

 

Trustee Park said he would be in favor of seeding  verses sodding.  He also asked  about revision #3 stating a maximum of 2,400 square feet.

 

Mr. Muetz that is an error in the memo and it should have stated minimum of 2,400 square feet.

 

Trustee Wilson asked if the minimum square footage is consistent with the other houses in the area.

 

Mr. Minchillo the homes will be bigger around 2,600 to 2,800 square feet.  He said the all the homes will be custom built.

 

Trustee Wilson motioned, seconded by Trustee Balmes, to recommend the petition of Mike Minchillo Construction LLC for a first amendment to an annexation agreement, approved as Ordinance #2006-91, dated November 6, 2006.
