Call to Order

Mayor Kovarik called the meeting to order at 5:30 p.m.

Approval of Resolution 2012-20 authorizing execution of amended Mutual Release and Settlement Agreement between the Village of Gurnee and the PFC Geoffrey Morris Memorial Foundation.

 

      Trustee Park stated he was not involved in the initial decisions and spent a lot of time reviewing the matter, while trying to remove the emotional and personal conflicts from the subject.  He continued to say the cooperative efforts have collapsed and blame can be assigned to both sides involved.  Trustee Park stated he felt the best resolution of the matter is if both parties head in separate directions.  He stated the proposed settlement brought forward in August was not in the best interest of the Village.  Trustee Park continued to say his best solution was to determine if there is money due to the Foundation based on work at the site.  He stated the insurance company has now offered a generous settlement and it is his understanding that the Village is bound to this offer, unless it wants to put the costs of continuing the litigation on the residents.  He clarified the only difference between this agreement on the one considered December 17th is that the Foundation wants the rights to the memorial name.  He concluded by stating if this will end the litigation, the Village needs to get it done.

 

It was moved by Trustee Schwarz, seconded by Trustee Park approve Resolution 2012-20 authorizing execution of amended Mutual Release and Settlement Agreement between the Village of Gurnee and the PFC Geoffrey Morris Memorial Foundation.

ABSTAIN:         1-Morris

ABSENT:          1-Garner

Motion Carried.

It was moved by Trustee Balmes, seconded by Trustee Schwarz to adjourn the meeting.

 

Voice Vote:      ALL AYE:         Motion Carried.

 

Mayor Kovarik adjourned the meeting at  5:30 p.m.
